Welcome to Batur Tours. By booking any tour, activity, transportation service, or package through Batur Tours, you agree to the following Terms and Conditions.
1. Booking Confirmation
All bookings are subject to availability.
A booking is considered confirmed only after:
- Payment is successfully received; or
- A booking confirmation message has been issued by Batur Tours.
Batur Tours reserves the right to decline or cancel any booking due to operational, safety, or unforeseen circumstances.
2. Payment Policy
All prices displayed on our website are subject to change without prior notice.
Customers are responsible for ensuring that payment information provided is accurate and valid.
Any payment processing fees, bank fees, exchange rate differences, or international transaction charges are the responsibility of the customer.
3. Cancellation Policy
More Than 48 Hours Before Tour
Customers may cancel free of charge and receive a full refund.
24–48 Hours Before Tour
A cancellation fee of 50% of the total booking amount may apply.
Less Than 24 Hours Before Tour
No refund will be issued.
No Show
Failure to arrive at the agreed pickup location, failure to respond to driver contact attempts, or failure to participate in the tour at the scheduled time will be considered a No Show.
No refunds will be provided for No Shows. This policy is commonly used by tour operators and booking platforms.
4. Tour Rescheduling
One free reschedule may be granted if requested at least 24 hours before the scheduled tour.
Rescheduling requests made less than 24 hours before departure are subject to availability and may incur additional costs.
5. Weather and Natural Conditions
Mount Batur is an active volcano and weather conditions may change rapidly.
Sunrise visibility, weather conditions, cloud coverage, volcanic activity, traffic conditions, and natural events are outside the control of Batur Tours.
Refunds will not be issued due to:
- Poor visibility
- Rain
- Fog
- Cloud coverage
- Customer dissatisfaction with weather conditions
If local authorities close access to Mount Batur or conditions are deemed unsafe, Batur Tours may:
- Reschedule the tour; or
- Provide a partial or full refund at our discretion.
6. Customer Responsibility
Customers are responsible for:
- Reading the tour description before booking
- Arriving on time
- Providing accurate contact information
- Following guide and driver instructions
- Wearing appropriate clothing and footwear
Failure to follow safety instructions may result in removal from the tour without refund.
7. Physical Fitness Requirement
Certain tours involve trekking, hiking, uneven terrain, and outdoor activities.
Customers are responsible for assessing their own fitness and medical condition before booking.
Batur Tours shall not be responsible for injuries or health issues resulting from pre-existing medical conditions.
Pregnant travelers, individuals with heart conditions, serious medical issues, or mobility limitations should consult a medical professional before participating.
8. Liability Limitation
By participating in any activity, customers acknowledge that adventure tourism involves inherent risks.
To the maximum extent permitted by law, Batur Tours shall not be liable for:
- Personal injury
- Illness
- Accidents
- Property loss or damage
- Delays caused by traffic
- Weather disruptions
- Force majeure events
- Actions of third-party service providers
Participation is at the customer’s own risk.
9. Personal Belongings
Customers are solely responsible for their personal belongings.
Batur Tours is not responsible for lost, stolen, or damaged items during transportation or activities.
10. Force Majeure
Batur Tours shall not be liable for cancellation, delay, interruption, or modification caused by circumstances beyond reasonable control, including:
- Volcanic activity
- Earthquakes
- Floods
- Landslides
- Severe weather
- Government restrictions
- Civil disturbances
- Transportation disruptions
- Pandemics
In such situations, refunds, credits, or rescheduling options will be provided at the discretion of Batur Tours.
11. Chargebacks and Payment Disputes
Customers agree to contact Batur Tours directly before initiating any chargeback or payment dispute.
Fraudulent chargebacks, false claims, or disputes filed after receiving services may result in:
- Submission of booking records,
- Driver records,
- WhatsApp communications,
- GPS pickup evidence,
- Tour documentation,
to payment processors, banks, legal authorities, or dispute resolution services.
This clause helps protect operators against fraudulent refund claims.
12. Third-Party Services
Some services may involve third-party operators, including:
- ATV operators
- Rafting companies
- Hot spring facilities
- Ferry operators
- Transportation providers
Batur Tours acts as a booking coordinator and is not liable for acts, omissions, delays, or service failures caused by third-party providers.
13. Photography and Marketing
Photos and videos taken during tours may be used for:
- Website content
- Social media
- Advertising materials
Customers who do not wish to appear in marketing materials must inform the guide before the tour begins.
14. Complaints
Any complaints must be submitted within 24 hours after completion of the tour.
Complaints submitted after this period may not be eligible for review or compensation.
15. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.
Any dispute shall first be resolved through good-faith negotiation before legal action is pursued.
